Well i am now 3 years in and this day 3 years ago i was in my early staged of CES. My claim against my doctor was initiated almost 3 years ago now. On the 17 th March my doctors were supposed to have given their letter of reply.
This letter of reply is what i have been waiting for as it will include either an admission or not as it may be.This response will be the indicator as to wether my case will go to court and settle out of court. So far this date has been put back several times with different excuses.The latest one is that the barrister is not ready
Now they cannot fulfill their latest date which technically was the final date and we can now issue court proceedings. The decision has been to allow them a further 2 months because three doctors in total were at fault. So if it were to go to court now then all 3 would be sued...this would mean 2 more sets of expert witnesses and to go through all the tests again but twice more.
It seems the best is option to give them more time for them to prepare their reply..its just very frustrating and slow. I expect that now we will be looking at least another year possibly two for everything to be finalised..
I'm sorry, Lαrα! You've got to be drowning in frustration! I hope they pay for their mistakes! I'm glad you took action!
I decided against filing a lawsuit with the hospital that dealt with my first and second surgeries and half-ass rehab. I hate having to relive the accident, and hate reliving the crappy care even more, so I decided to move on.
I'm glad you are getting something done. The malpracticing doctors don't deserve to get off Scott free!
Isn't great Lαrα, the lawyers and doctors are still sitting there making huge sums of money, and we the injured have no option but to sit and wait with little or no income for years while they stuff around.
Its pretty guys indeed..i wouldnt let this go no matter what. Not after what i went through and even after repeated visits to my doctors asking for help....
Three doctors could have been sued, its crazy when you think about the trust we put in the professionals and the effects on peoples lives when they fail to carry out their duty of care.
I now have someone come privately 5 mornings a week to work on my feet and legs etc because i want to keep myself healthy and maintain my mobility. So i fund this myself but realistically my doctors should be responsible
Sorry to hear it's taking so long. Sometimes I think lawyers main objective is delay.
I've been dealing with tons of lawyers every since my accident and unfortunately, I think you're right dlevy. The longer the case drags on, the more money in their pockets!
Sorry to hear you have to wait yet again Lara I think it as been the same since time began for lawyers to drag their feet. I guess they think or hope people will run out of patience or money and just give up. Well done you for been able to hang in there.
Just updating my situation...All the medical experts who are giving evidence on my behalf were asked to look over the evidence again and confirm that they felt strongly in support of my defense.
My barrister was also asked if she felt that the case was strong enough to push forward. All the reports came back positive and court proceedings were issued on the 15 May.
Im relieved that we are now at this stage. I will now be assessed at my home by a physiotherapist and an occupational therapist. Im also going to be assessed by a neuro physchologist.
Damages and losses are now going to be accounted for...at last its a little nearer.
My case is starting next week apparently, first week of June. I don't have to be there yet, not sure why. I just want it all over so I can get my boom trike.
